Terms of Use (Software)

This is an English translation of our Japanese ソフトウェア利用規約, provided for convenience. If the two versions differ, the Japanese version prevails. We are happy to answer questions in English at [email protected].

These terms set out the conditions for using the software that TemaLab (“we” or “us”) provides through our software store (the “Software”). By installing or purchasing the Software, you agree to these terms.

Article 1 (License to use)

We grant you a non-transferable, non-exclusive right to use the Software. Copyright and all other rights in the Software belong to us. Third-party software included in the Software is subject to its own license (listed under “About” in the Software).

Article 2 (Free version and full version)

Without a registered license (the free version), some functions are limited as described on each product's page and in the Software. For TemaSel, exporting and copying to Excel or CSV is limited to 3 pages with tables per export. The free version is for checking the results before you buy. Registering a license removes these limits.

Article 3 (Licenses)

  1. One license can be registered on up to 2 PCs used by you personally. You can deactivate a registered PC from within the Software and register a different one.
  2. Monthly and yearly licenses are valid during the subscription period. After you cancel, the license remains valid until the end of the current period and then the Software returns to the free version.
  3. One-time purchase licenses are valid with no time limit and include free updates within the major version purchased (for example, 1.x).
  4. To verify licenses, the Software communicates with our server over the internet. It does not send the files or documents you are working on.

Article 4 (Prohibited conduct)

  1. Transferring, lending or publishing your license key to any third party
  2. Modifying or decompiling the Software, or circumventing license verification (except where permitted by law)
  3. Redistributing or reselling the Software

Article 5 (Fees, cancellation and refunds)

Fees, payment timing, how to cancel and refund conditions are as set out in our Legal Notice under the Specified Commercial Transactions Act and Refund Policy. If a payment is refunded or charged back, we may deactivate the corresponding license.

Article 6 (Warranty and limitation of liability)

  1. We do not warrant that the Software is fit for any particular purpose of yours or that it is free of defects. We will respond in good faith to reports of problems.
  2. If you suffer any loss from using the Software, our liability is limited to the fees you paid us in the most recent 12 months, except where the loss is caused by our intentional misconduct or gross negligence.
  3. The Software does not overwrite your source files, but please always back up important data yourself.

Article 7 (Changes to these terms)

We may change these terms as necessary. We will announce important changes in advance on our website or by email.

Article 8 (Governing law and jurisdiction)

These terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the Kagoshima District Court in Japan as the court of first instance.
